Terms & Conditions
Q – MART (PTY) LTD (hereinafter referred to as Q – MART)will be giving away a Used Nissan NP200 bakkie to a Q – MART Independent Agent or Retail Dealer as a Giveaway in terms of the Q – MART Vehicle Giveaway Competition. See below for details:
Qualifying Persons
You must be an Independent Agent or Retail Dealer for Q – MART to be eligible to partake.
You must be 18 (Eighteen) years or older.
You must have a valid South African driver’s licence or Permit.
This Competition explicitly excludes the general public and all other shareholders, directors, employees, partners, agents and consultants (and their respective life partners, business partners and immediate families) of Hello Group (Pty) Ltd., registration number 2012/106854/07, with registered office at Building 12, Centurion Gate Business Park, Centurion, South Africa 0157 (“HG”) and all of HG’s current and future affiliates, sistercompanies, parent companies, related entities or divisions including but not limited to Q – MART.
You must be an Active Independent Agent or Retail Dealer. Actively distributing Q – MART Sim Cards and earning commission thereon for at least 3 months, or longer.
You must have been aware of, read and agreed to these Terms and Conditions to be a
Qualifying Person.
Competition Entry
Buy 1 pack of 1000 Prepaid Sim Cards, the Qualifying product, for 1 entry into the Competition. The Qualifying product shall be available from Q Market on the Q Mobile Application. Buying multiple Qualifying products will give you automatic multiple entries.
Random Draw
Whereby Q – MARTs Head Office will draw the Winner by means of a random electronic draw.
Winner requirements
The Winner of this Q – MART Vehicle Giveaway Competition, will be the Qualifying Q – MART Independent Agent or Retail Dealer as determined in accordance with the abovementioned Random Draw.
Notification to the Winner
The Winner will be notified telephonically after the internal random electronic draw has been verified and confirmed.The Winner must accept the Giveaway within 24 Hours.
Failure to accept the Giveaway
In the event the Winner fails to accept or notify Q – MART of his/her acceptance of the Giveaway within 24 hours, the Giveaway shall be forfeited to the Runner up at Q – MARTs’ sole discretion.
Photograph & Promotion Session
After acceptance, the Winner will be obligated to attend a Photograph and Promotion Session hosted at Q – MARTs’ Head Office located at 124 Akkerboom St, Zwartkop, Centurion, 0051 within 10 days from date of notification of acceptance to claim the Giveaway and to deal with ancillary matters related to the Giveaway, including but not limited to a Photograph and Promotion Session. This is a material condition of claiming the Giveaway.
Publishing Condition
At Q – MART s’ sole discretion, the name and photographs of the Winner will be published on the Q – MART website (www.qmart.co.za) and on various social media platforms, once the Winner has been verified and confirmed. The Winners’ name will also be featured in national press advertisements after the Competition has closed. By accepting the Giveaway, the Winner of the Q – MART Vehicle Giveaway Competition agrees that Q – MART may use their names and photographs taken for any future marketing material advertised by Q – MART in print and digital media.
Failure to attend the Photograph & Promotion Session
f the Winner fails to attend the Photograph and Promotion Session without 24 hours’ notice to Q – MART for failing to attend , the Winner will forfeit the Giveaway to Q – MART at Q – MARTs’ sole discretion.
Vehicle licensing & Registration
The Winner must allow Q – MART a reasonable period to arrange for the Giveaway to be registered and licensed in their respective name and delivered. The Winner must provide Q – MART with all the Winners information and original documentation required for this purpose, including an identity document, together with a valid South African driver’s licence or Permit, and a valid proof of residence. These documents must be provided at the Photograph and Promotion Session.
After the Giveaway is accordingly registered and licensed, Q – MART will deliver the Giveaway to the Winner at an agreed time and place.
Ownership, Risk & Benefit
Ownership, Risk and Benefit of the Giveaway shall pass from Q – MART to the Winner upon registration of the Giveaway and delivery of the Giveaway will be arranged after registration.
Non- transferability
The Giveaway, a Used Nissan NP200 bakkie, may not be transferred or exchanged for cash or for any other goods or services.
Limitation of Liability of The Giveaway
The Used Nissan NP200 bakkie is given “voetstoots” to the Winner. HG’s current and future affiliates, sister-companies, parent companies, related entities or divisions including but not limited to Q – MART shall not be liable for any defects in the Giveaway, latent or otherwise
Limitation of Liability of The Competition
The Participants hereby waive any right they may have to claim any loss or damage against HG’s current and future affiliates, sister-companies, parent companies, related entities or divisions including but not limited to Q – MART.
Severability
If any Term or Condition of this document is found to be invalid, unlawful or unenforceable, that provision shall be severable from the remaining provisions of this document, which shall continue to be valid and enforceable.
Legal Undertaking
By participating in the Q – MART Vehicle Giveaway Competition, you will be deemed to have legal capacity to do so, you have read , understood and accept all these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.
THE DECISION OF Q - MART AND ITS JUDGES ARE FINAL AND BINDING.

- The Pre-screening , Capturing and Transmission of Customer Information to ECSP’s;
- All Representations, Warranties, undertakings, duties, and obligations incorporated in the Q- Marts (Pty) Ltd. RICA policy;
- Adherence to the training;
- Conducting all services envisioned by virtue of appointment as a RICA Agent in a non- discriminatory, courteous, and friendly manner;
- Compliance with all process as communicated to the RICA Agent by Q-Mart (Pty) Ltd.’s during training or otherwise;
- Ensuring that no Customer Information is disclosed, intercepted, copied, or viewed by any other person or entity;
- Informing each and every potential Customer, a SIM-card will not be activated until Pre- Screening, Capturing, Transmission and Registration has taken place;
- If the Terminal Equipment is lost, stolen, damaged, faulty or in any manner is rendered unusable for its purpose, the agent shall report this to Q-Mart (Pty) Ltd.;
- Only Transmitting Captured Customer Information;
- If it is suspected that an identification document submitted as Customer Information is invalid, the RICA Agent must within 24 (twenty-four) hours, report the matter to a police official at any South African Police station and shall immediately inform Q-Mart (Pty) Ltd.;
- Indemnifying Q-Mart (Pty) Ltd. against any loss or claims resulting from any of its conduct or omissions;
- all the information detailed above, in the application, is true and correct; and
- Any information arising in the ordinary course of business and proper compliance with requirements relating to such information.

2. By virtue of the abovementioned Applicant being appointed as a RICA Agent, the RICA Agent confirms and agrees to not engage in any prohibit conduct in breach of Q-Mart (Pty) Ltd. RICA policy.
- The RICA Agent shall not perform the activity of bulk RICA i.e., bulk registrations of SIM-cards or Pre-RICA i.e., registering any SIM-Card without the Customer being present & presenting the appropriate documentation;
- The RICA Agent shall not charge any Customer for any for any services rendered by virtue of their appointment as a RICA Agent; and
- The RICA Agent shall not charge any Customer for any for any services rendered by virtue of their appointment as a RICA Agent; and

3. Important Notice
- This RICA Agent application form/Agreement constitutes part of the Agreement between the RICA Agent and Q-Mart (Pty) Ltd. By signature hereto the RICA Agents duly declares that they have read, understood, and agreed to be bound by this RICA Agent application form/Agreement and the Q-Mart (Pty) Ltd. RICA policy. The parties agree that this is a material component of the agreement and any conduct by the RICA Agent contrary to this provision will amount to a breach of this Application/Agreement and the Q-Mart (Pty) Ltd. RICA Policy.
- Provision 1 and 2 shall not be construed as the RICA Agents entire Responsibilities and prohibited conduct and this Application/Agreement must be read together with the Q-Mart (Pty) Ltd.’s RICA Policy.
- Nothing contained herein shall be deemed to constitute a partnership, joint venture, or the like between the Parties. This Application/Agreement will not create an employee employer relationship.
